Most people seeking a divorce in Alicante assume the process will take months or even years.

It's logical to think so, the Courts in Alicante have waiting times of between 5 and 12 months for a mutual consent divorce.

What very few know is that there is a completely different route that resolves the same procedure in approximately 2 to 3 days.

This is the notarial divorce, regulated by Law 15/2015 on Voluntary Jurisdiction, with the same legal validity as a judicial resolution, it does not require a lawyer and the cost is usually lower.

The only condition is that there are no minor children. If this requirement is met, the express divorce in Alicante can be resolved in 3 steps:

  1. Drafting of the regulatory agreement, in less than 24 hours.
  2. Signing at the notary, usually within 24 to 48 additional hours.
  3. Registration in the Civil Registry on the same day as the signing.

Regarding the cost, it is advisable to distinguish two concepts:

  1. The fees of the specialised law firm are €250 per spouse, which includes lawyers, processors, VAT consultations and assistance at the notary.
  2. The notary fees are approximately €180 and are paid directly to the notary on the day of signing.

Both concepts together are still lower than the total cost of a judicial divorce when adding the fees of the lawyer, procurator, taxes and the months of waiting.

The province of Alicante is home to one of the largest communities of European residents in Spain (British, Germans, Dutch, Belgians and Scandinavians) in the Vega Baja, Marina Alta, Marina Baixa and the metropolitan area of Alicante-Elche.

For them, the notarial divorce has an additional advantage since, if one of the spouses resides outside Spain, they can grant a specific power of attorney before a notary and the other party signs in Alicante, without the need to travel.

In the event of having joint assets, a matter that is unrelated to the divorce procedure, their liquidation and allocation can be carried out at the same or different notary and in the corresponding deed (without the need for lawyers).

The recommendation before starting any process is to always check if the case meets the requirements for the notarial route.

If it does, there is no reason to wait nine months in court when the same legal result can be obtained in approximately 72 hours.
