The State Agency for Labour and Social Security Inspection has opened a case against the **Government of Catalonia** for **207 interns** from the **Culture Department**. The agency is demanding **2.16 million euros** in unpaid contributions.
According to elmundo.es, the State Agency for Labour and Social Security Inspection (OEITSS) wants to determine whether the 207 interns have performed structural tasks in recent years that were not educational in nature. The investigation affects the Culture Department of the Generalitat.
The interns were paid 1,250 euros per month, an amount below the minimum wage as it did not include extra payments. Their working hours were from 8:00 to 15:00, and according to the inspection, they carried out tasks typical of civil servants and staff, without rights such as holidays.
According to the Labour Inspection report, some tasks were administrative or mechanical, for which the interns were overqualified. Others went beyond what is expected in an internship and resembled those of the permanent staff position.
The agency, under the Ministry of Labour, is demanding 2.16 million euros from the Generalitat in Social Security contributions that were not paid between October 2024 and July 2026. The calculation is based on the salary of a senior administrative technician and includes a 20% surcharge for late payment.
“They have an essentially educational nature and their configuration, development, and purpose fully comply with the legal regime applicable to internship scholarships.”
This is how the Culture Department defends its position, which has appealed the case. The Generalitat has also appealed a resolution from the General Treasury of the Social Security, which automatically deregistered the interns and registered them as workers.
The procedure remains open, so the appeals submitted by the regional administration must be resolved before the claim becomes final.
