Antoni Casas reports that Barcelona City Council requires signed authorisation from his two deceased parents to access the transfer files he has been requesting for over two years.

The municipal request, dated 2 October, responds to a request that Casas submitted on 20 September. To process access to documents containing third-party data, the Administration asks him to prove his legitimacy according to data protection regulations, and one of the options includes an "express and signed authorisation from both of his parents".

Casas responds in a letter registered on 6 October and reproduces the municipal demand verbatim. His parents, Ramon Casas Noguera and M. Rosa Riera Castell, died while awaiting a resolution regarding their transfer from a residence in Vic to a public centre in Barcelona.

"My parents are dead. Both of them. Mayor, how does he expect the dead to sign?"

The son claims he has already provided the family book and death certificates, documents that prove the relationship and the deaths. He demands that the City Council acknowledge his legitimacy and grant him full access to the files DP/2016/038311 and DP/2023/039089, along with all the background information regarding the transfer.

Casas also criticises that the notification does not include any names, only administrative titles. According to his account, before receiving the request, someone had warned him that a notification would arrive that he "would not like". He maintains that, after more than 700 days of dealings, questions about who made the decision, on what basis, and who is responsible remain unanswered.

The case dates back to the transfer request. His father suffered from advanced Alzheimer's and his mother from metastatic cancer, and both were completely dependent on others. Casas, an only child living in Barcelona, wanted to care for them himself after the birth of his daughter, but his wife's and the baby's postpartum issues prevented him from continuing to do so as he had before.

If the City Council believes it cannot provide the information, Casas demands a formal, reasoned resolution identifying the responsible person. Meanwhile, the file remains open and the request requires presenting new proof of legitimacy before accessing the documentation.
