The Tenants' Union has filed a contentious-administrative appeal against the Barcelona City Council for failing to act on the urban infractions at the property on Consell de Cent 538.

The Barcelona City Council did not respond to the request that the union submitted on 13 March, and the legal deadline expired on 15 June. In light of this silence, the Tenants' Union of Catalonia has turned to the contentious section of the Barcelona Court of First Instance.

The origin of the conflict lies in the building at Consell de Cent 538, where the real estate company Vandor Real Estate has renovated most of the property. According to the union, the company has resorted to minor procedures instead of those required by regulations, which would mandate that 30% of the housing be allocated for social housing.

This obligation would mean that eight homes would become protected. A municipal inspection had already confirmed the extensive renovation, but the union argues that the council has not opened the legal protection file that was requested to compel the developer to comply.

The claim seeks to compel the City Council to act and not remain merely as an inspector.

Additionally, the union announces two more contentious appeals in the coming months, for the properties at Nápoles 206 and Rocafort 219. The aim is to set a precedent that forces the City Council to apply the reservation of social housing in all cases.

For the residents of Eixample and other neighbourhoods undergoing rehabilitation works, the outcome of these proceedings could determine whether rental building renovations must include social housing. The next steps will depend on the acceptance of the appeal by the Barcelona Court of First Instance.
