Junts has filed a criminal complaint against Renfe and Adif for the fatal accident in Gelida. The party also demands the full transfer of Rodalies to Catalonia.

A train driver died in January in the railway accident in Gelida (Barcelona), and now the case is heading to court. The independentist party has lodged a criminal complaint against Renfe and Adif, registered by lawyer Gonzalo Boye, who represents Carles Puigdemont.

The information, reported by La Razón, indicates that the complaint was filed on 20 October, still before the accident in Toledo, which has resulted in 69 fatalities and has raised questions about the state of the railway service like never before.

The spokesperson for Junts in the Parlament, Salvador Vergés, explains that the action responds to the Govern's failure to comply with a parliamentary mandate that requested taking Renfe and Adif to court. His party had already proposed measures to address the railway crisis just days after the Gelida disaster.

“We want the responsibility of Renfe and Adif to be investigated and for those who need to take responsibility to do so,” stated Vergés.

Although the complaint focuses on Gelida, it points to structural deficiencies in the system. According to the document, the events could constitute crimes of homicide and serious injury due to gross negligence, as well as a crime of catastrophic risk, due to possible negligence in maintenance, inspection, risk prevention, and safety measures.

The president of Junts in the Parlament, Mònica Sales, holds the president of the Generalitat, Salvador Illa, responsible for the collapse of Rodalies. She recalls that her party has called for the resignation of the Minister of Territory, Sílvia Paneque, without the president addressing that request.

Sales extends her criticism to healthcare, education, security, and housing. She laments that travelling by train in Catalonia has become uncertain, so users do not know how much time they will lose during their journey.

“We want Renfe out of Catalonia,” declared Sales.

Sales cites Ferrocarrils de la Generalitat (FGC) as an example and demands a full transfer of Rodalies, assuring that her party will not sit idly by until they achieve it.

The spokesperson for Junts in Congress, Míriam Nogueras, believes that the railway crisis demonstrates the exhaustion of the Spanish model, marked by years of disinvestment and poor planning. According to her data, the country allocated only 16% of railway spending to maintenance, nearly half of what France or Italy did.

“It cannot be that in 2026 people are afraid to take a train,” lamented Nogueras.

Nogueras shares the responsibility between the governments of PP and PSOE, demands explanations from the Prime Minister, Pedro Sánchez, and considers the resignation of the Minister of Transport, Óscar Puente, to be urgent. The judicial procedure is now pending the processing of the complaint.
